Use of the moto.free Service, including browsing, registration, logging in, and using services offered through it, is subject to the rules set out in these Terms of Service. Please read them carefully. These Terms of Service are effective from September 1, 2026.

1. General Provisions

These Terms define the rules by which the moto.free service provides access to its automotive classifieds platform, as well as the rights and obligations of all Users. The moto.free Service is available at the moto.free website and via mobile application. To access the Service's functionality, users need a device with internet access and a standard web browser.

2. Seller and Contact Details

The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.

3. Definitions

Terms used in these Regulations mean respectively: Service — the moto.free platform available at moto.free. User — any adult person using the Service. Advertiser — a User who has concluded an agreement with the Service for listing publication. Listing — content published by an Advertiser for the sale of a Listing Subject. Account — an individual User record enabling full use of the Service's functionality. Listing Subject — a single motor vehicle, motorcycle, moped, scooter, quad, or automotive part.

4. Rules for Using the Service

Browsing listings is free and available without registration. Adding listings and using the full functionality of the Service requires an active Account. Each User may have only one Account linked to one email address. Publishing content that is unlawful, misleading, or violates third-party rights is prohibited. moto.free reserves the right to remove listings that violate these Terms and to suspend or delete the Account of any User who commits violations.

5. Registration and Account

Account registration requires completing the registration form by providing an email address and a unique password, and accepting these Terms. The User is responsible for maintaining the confidentiality of their Account credentials and all actions performed using the Account. The Service reserves the right to suspend or delete an Account in the event of a Terms violation, inactivity for at least 36 months, or other justified reasons. A User may delete their Account at any time by contacting the Service.

6. Adding and Editing Listings

A listing must unambiguously relate to the sale of a single Listing Subject. The content of the listing must be truthful and legally accurate. An Advertiser may attach up to 9 photos of the Listing Subject. Photos must not contain contact details, website addresses, watermarks, or images of people. Adding listings unrelated to automotive topics, containing offensive, racist or discriminatory content, or relating to fully dismantled or burned-out vehicles is prohibited. The Advertiser bears full responsibility for published content and guarantees it complies with applicable law.

7. Paid Services, Prices and Payments

The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.

8. Withdrawal from the Contract and Refunds

A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.

9. Liability

The moto.free Service provides a platform for publishing listings and is not responsible for the content of listings published by Users, the accuracy of information provided, or the technical condition or legality of offered vehicles. The Service is not a party to transactions between Users. The User bears full responsibility for the content they publish and their actions within the Service. moto.free reserves the right to suspend or block a listing if it is found to be non-compliant with these Terms.

10. Personal Data Protection

The controller of Users' personal data is the owner of the moto.free Service. Personal data is processed in accordance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). Users have the right to access, rectify, delete, or restrict the processing of their data. Detailed rules regarding personal data processing, including information about Users' rights, are set out in the Privacy Policy available in the Service.

11. Complaint Procedure

Users have the right to file complaints regarding the operation of the Service, free services and paid services, including payments made. Complaints may be sent electronically to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. A complaint should include a description of the issue, the listing number and the date and amount of the payment (if applicable), and the User's contact details. The Seller processes complaints promptly, no later than 14 days from receipt, and notifies the User of the outcome electronically; failure to reply within that period means the complaint is upheld. Where a complaint is upheld and a paid service was not fully performed, the Seller refunds the corresponding part or the whole of the amount paid within 14 days, using the same payment method. Consumers may use out-of-court complaint and redress procedures, in particular by requesting assistance from a district (municipal) consumer ombudsman or applying for mediation or a ruling before a permanent consumer arbitration court at the regional Trade Inspection Authority; information about these procedures is available from the Polish Office of Competition and Consumer Protection (uokik.gov.pl).

12. Changes to the Terms

The moto.free Service reserves the right to amend these Terms for justified reasons, such as changes in applicable law, improvements to User security, or enhancements to the Service's operation. Users will be notified of any changes electronically and via a notice on the Service. Changes to the Terms take effect 14 days after Users are notified, unless the changes are required by mandatory law. Continued use of the Service after changes take effect constitutes acceptance of the amended Terms.

13. Final Provisions

These Terms of Service come into force on September 1, 2026. Matters not regulated by these Terms shall be governed by Polish law. All disputes related to services provided by the Service shall be resolved by competent Polish courts. Consumers may also use out-of-court dispute resolution procedures. If any provision of these Terms is declared invalid by a final court ruling, the remaining provisions shall remain in force.
