moto.free Hizmetinin kullanımı; gezinme, kayıt, erişim ve sunulan hizmetlerin kullanımı dahil olmak üzere bu Kullanım Koşullarında belirlenen kurallara tabidir. Lütfen dikkatlice okuyun. Bu Kullanım Koşulları 1 Eylül 2026 tarihinden itibaren geçerlidir.
1. Genel hükümler
Bu Kullanım Koşulları, moto.free hizmetinin araç ilan platformuna erişim sağladığı kuralları ve tüm Kullanıcıların hak ve yükümlülüklerini tanımlamaktadır. moto.free Hizmeti, moto.free web sitesinde ve mobil uygulama aracılığıyla kullanılabilir.
2. Seller and Contact Details
The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.
3. Tanımlar
Bu Kullanım Koşullarında kullanılan terimler sırasıyla şu anlamlara gelir: Hizmet — moto.free platformu. Kullanıcı — Hizmeti kullanan herhangi bir yetişkin. Reklamveren — Hizmet ile ilan yayınlama sözleşmesi imzalamış Kullanıcı. İlan — Reklamverenin bir İlan Nesnesi satışı için yayınladığı içerik. Hesap — Kullanıcının Hizmetin tüm özelliklerini kullanmasına olanak tanıyan bireysel kaydı.
4. Hizmet kullanım kuralları
İlanları görüntülemek ücretsizdir ve kayıt gerektirmez. İlan eklemek ve Hizmeti tam olarak kullanmak etkin bir Hesap gerektirir. Her Kullanıcının bir e-posta adresiyle ilişkilendirilmiş yalnızca bir Hesabı olabilir. Yasa dışı, yanıltıcı veya üçüncü tarafların haklarını ihlal eden içerik yayınlamak yasaktır. moto.free, bu Koşulları ihlal eden ilanları silme hakkını saklı tutar.
5. Kayıt ve Hesap
Hesap kaydı için kayıt formunun e-posta adresi ve benzersiz şifre ile doldurulması ve bu Kullanım Koşullarının kabul edilmesi gerekmektedir. Kullanıcı, Hesap kimlik bilgilerinin gizliliğini korumaktan sorumludur.
6. İlan ekleme ve düzenleme
Bir ilan, yalnızca tek bir İlan Nesnesi satışına açıkça atıfta bulunmalıdır. İlan içeriği doğru ve hukuken uygun olmalıdır. Reklamveren, İlan Nesnesinin 9 adede kadar fotoğrafını ekleyebilir.
7. Paid Services, Prices and Payments
The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.
8. Withdrawal from the Contract and Refunds
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.
9. Sorumluluk
moto.free Hizmeti, ilan yayınlama platformu sağlamaktadır ve Kullanıcılar tarafından yayınlanan ilanların içeriğinden, verilen bilgilerin doğruluğundan, sunulan araçların teknik durumundan veya hukuki durumundan sorumlu değildir.
10. Kişisel verilerin korunması
Kullanıcıların kişisel verilerinin işlenmesinden moto.free Hizmetinin sahibi sorumludur. Kişisel veriler, özellikle GDPR (AB) 2016/679 olmak üzere yürürlükteki mevzuata uygun olarak işlenmektedir.
11. Şikayet prosedürü
Kullanıcılar, Hizmetin işleyişine ilişkin şikayette bulunma hakkına sahiptir. Şikayetler, Hizmetin alt bilgisinde belirtilen e-posta adresine elektronik olarak gönderilebilir. Hizmet, şikayetleri en geç 14 gün içinde işleme alacaktır.
12. Kullanım Koşullarında değişiklikler
moto.free Hizmeti, haklı gerekçelerle bu Kullanım Koşullarını değiştirme hakkını saklı tutar. Kullanıcılar değişiklikler hakkında elektronik yolla bilgilendirilecektir. Değişiklikler, Kullanıcılara bildirimden 14 gün sonra yürürlüğe girer.
13. Son hükümler
Bu Kullanım Koşulları 1 Eylül 2026 tarihinden itibaren geçerlidir. Bu Koşullarda düzenlenmeyen konular Polonya hukukuna tabidir.
