El uso del Servicio moto.free, incluida su navegación, registro e inicio de sesión y el uso de los servicios ofrecidos a través de él, está sujeto a las normas establecidas en este Reglamento. Por favor, léelo detenidamente. Este Reglamento es efectivo desde el 1 de septiembre de 2026.
1. Disposiciones generales
Este Reglamento define las normas mediante las cuales el servicio moto.free proporciona acceso a su plataforma de anuncios de vehículos, así como los derechos y obligaciones de todos los Usuarios. El Servicio moto.free está disponible en el sitio web moto.free y a través de la aplicación móvil.
2. Seller and Contact Details
The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.
3. Definiciones
Los términos utilizados en este Reglamento significan respectivamente: Servicio — la plataforma moto.free disponible en moto.free. Usuario — cualquier persona adulta que utilice el Servicio. Anunciante — un Usuario que ha concluido un acuerdo con el Servicio para la publicación de anuncios. Anuncio — contenido publicado por un Anunciante para la venta de un Objeto de Anuncio. Cuenta — un registro individual de Usuario que permite el uso completo de la funcionalidad del Servicio.
4. Normas de uso del Servicio
Explorar anuncios es gratuito y está disponible sin registro. Añadir anuncios y usar la funcionalidad completa del Servicio requiere una Cuenta activa. Cada Usuario puede tener una sola Cuenta vinculada a una dirección de correo electrónico. Está prohibido publicar contenido ilegal, engañoso o que viole los derechos de terceros. moto.free se reserva el derecho de eliminar anuncios que infrinjan este Reglamento.
5. Registro y Cuenta
El registro de la Cuenta requiere completar el formulario de registro proporcionando una dirección de correo electrónico y una contraseña única, y aceptar este Reglamento. El Usuario es responsable de mantener la confidencialidad de sus credenciales de Cuenta.
6. Añadir y editar anuncios
Un anuncio debe referirse inequívocamente a la venta de un único Objeto de Anuncio. El contenido del anuncio debe ser veraz y legalmente preciso. Un Anunciante puede adjuntar hasta 9 fotos del Objeto de Anuncio.
7. Paid Services, Prices and Payments
The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.
8. Withdrawal from the Contract and Refunds
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.
9. Responsabilidad
El Servicio moto.free proporciona una plataforma para publicar anuncios y no es responsable del contenido de los anuncios publicados por los Usuarios, la exactitud de la información proporcionada ni el estado técnico o legalidad de los vehículos ofrecidos.
10. Protección de datos personales
El responsable del tratamiento de los datos personales de los Usuarios es el propietario del Servicio moto.free. Los datos personales se procesan de acuerdo con la legislación aplicable, incluido el RGPD (UE) 2016/679.
11. Procedimiento de reclamaciones
Los Usuarios tienen derecho a presentar reclamaciones sobre el funcionamiento del Servicio. Las reclamaciones pueden enviarse electrónicamente a la dirección de correo electrónico indicada en el pie del Servicio. El Servicio procesará las reclamaciones a más tardar en un plazo de 14 días.
12. Cambios en el Reglamento
El Servicio moto.free se reserva el derecho de modificar este Reglamento por razones justificadas. Los Usuarios serán notificados de cualquier cambio electrónicamente. Los cambios entran en vigor 14 días después de notificar a los Usuarios.
13. Disposiciones finales
Este Reglamento entra en vigor el 1 de septiembre de 2026. Los asuntos no regulados por este Reglamento se regirán por la legislación polaca.
