Использование Сервиса moto.free, включая его навигацию, регистрацию, вход в систему и использование предлагаемых услуг, подчиняется правилам, установленным в настоящих Условиях использования. Пожалуйста, внимательно прочитайте их. Настоящие Условия использования действуют с 1 сентября 2026 года.
1. Общие положения
Настоящие Условия использования определяют правила, по которым сервис moto.free предоставляет доступ к своей платформе объявлений о транспортных средствах, а также права и обязанности всех Пользователей. Сервис moto.free доступен на сайте moto.free и через мобильное приложение.
2. Seller and Contact Details
The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.
3. Определения
Термины, используемые в настоящих Условиях, означают: Сервис — платформа moto.free. Пользователь — любое совершеннолетнее лицо, использующее Сервис. Рекламодатель — Пользователь, заключивший соглашение с Сервисом о публикации объявлений. Объявление — контент, опубликованный Рекламодателем для продажи Предмета объявления. Аккаунт — индивидуальная регистрация Пользователя, позволяющая в полной мере пользоваться функциями Сервиса.
4. Правила использования Сервиса
Просмотр объявлений является бесплатным и доступен без регистрации. Добавление объявлений и полноценное использование Сервиса требует активного Аккаунта. Каждый Пользователь может иметь только один Аккаунт, привязанный к адресу эл. почты. Запрещается публиковать незаконный, вводящий в заблуждение или нарушающий права третьих лиц контент. moto.free оставляет за собой право удалять объявления, нарушающие настоящие Условия.
5. Регистрация и Аккаунт
Регистрация Аккаунта требует заполнения регистрационной формы с указанием адреса эл. почты и уникального пароля, а также принятия настоящих Условий использования. Пользователь несёт ответственность за сохранение конфиденциальности учётных данных своего Аккаунта.
6. Добавление и редактирование объявлений
Объявление должно однозначно относиться к продаже одного Предмета объявления. Содержание объявления должно быть достоверным и юридически корректным. Рекламодатель может прикрепить до 9 фотографий Предмета объявления.
7. Paid Services, Prices and Payments
The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.
8. Withdrawal from the Contract and Refunds
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.
9. Ответственность
Сервис moto.free предоставляет платформу для публикации объявлений и не несёт ответственности за содержание объявлений, опубликованных Пользователями, достоверность предоставленной информации, а также техническое состояние или законность предлагаемых транспортных средств.
10. Защита персональных данных
Оператором персональных данных Пользователей является владелец Сервиса moto.free. Персональные данные обрабатываются в соответствии с действующим законодательством, в частности Регламентом (ЕС) 2016/679 (GDPR).
11. Процедура подачи жалоб
Пользователи вправе подавать жалобы относительно работы Сервиса. Жалобы могут быть направлены в электронном виде на адрес эл. почты, указанный в подвале Сервиса. Сервис рассматривает жалобы в течение максимум 14 дней.
12. Изменения в Условиях использования
Сервис moto.free оставляет за собой право вносить изменения в настоящие Условия использования по обоснованным причинам. Пользователи будут уведомлены о любых изменениях в электронном виде. Изменения вступают в силу через 14 дней после уведомления Пользователей.
13. Заключительные положения
Настоящие Условия использования вступают в силу 1 сентября 2026 года. Вопросы, не урегулированные настоящими Условиями, подчиняются польскому праву.
