Використання Сервісу moto.free, включно з переглядом, реєстрацією, доступом та використанням пропонованих послуг, регулюється правилами, встановленими цими Умовами використання. Будь ласка, прочитайте їх уважно. Ці Умови використання набирають чинності з 1 вересня 2026 року.
1. Загальні положення
Ці Умови використання визначають правила надання доступу до платформи оголошень транспортних засобів Сервісу moto.free, а також права та обов'язки всіх Користувачів. Сервіс moto.free доступний на сайті moto.free та через мобільний додаток.
2. Seller and Contact Details
The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.
3. Визначення
Терміни, що використовуються в цих Умовах, мають такі значення: Сервіс — платформа moto.free. Користувач — будь-яка повнолітня особа, що користується Сервісом. Рекламодавець — Користувач, що уклав угоду з Сервісом для публікації оголошень. Оголошення — контент, опублікований Рекламодавцем для продажу Об'єкта оголошення. Акаунт — індивідуальна реєстрація Користувача, що дозволяє повноцінно користуватися функціями Сервісу.
4. Правила використання Сервісу
Перегляд оголошень є безкоштовним і доступним без реєстрації. Додавання оголошень та повноцінне використання Сервісу потребує активного Акаунту. Кожен Користувач може мати лише один Акаунт, пов'язаний з адресою ел. пошти. Забороняється публікувати незаконний, оманливий вміст або вміст, що порушує права третіх осіб. moto.free залишає за собою право видаляти оголошення, що порушують ці Умови.
5. Реєстрація та Акаунт
Реєстрація Акаунту вимагає заповнення реєстраційної форми з адресою ел. пошти та унікальним паролем, а також прийняття цих Умов використання. Користувач несе відповідальність за збереження конфіденційності облікових даних Акаунту.
6. Додавання та редагування оголошень
Оголошення повинне однозначно стосуватися продажу одного Об'єкта оголошення. Зміст оголошення має бути правдивим і юридично коректним. Рекламодавець може додати до 9 фотографій Об'єкта оголошення.
7. Paid Services, Prices and Payments
The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.
8. Withdrawal from the Contract and Refunds
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.
9. Відповідальність
Сервіс moto.free надає платформу для публікації оголошень і не несе відповідальності за зміст оголошень, опублікованих Користувачами, точність наданої інформації, технічний стан або законність пропонованих транспортних засобів.
10. Захист персональних даних
Відповідальним за обробку персональних даних Користувачів є власник Сервісу moto.free. Персональні дані обробляються відповідно до чинного законодавства, зокрема GDPR (ЄС) 2016/679.
11. Процедура подання скарг
Користувачі мають право подавати скарги щодо роботи Сервісу. Скарги можна надсилати електронно на адресу ел. пошти, зазначену в підвалі Сервісу. Сервіс розглядатиме скарги протягом не більше 14 днів.
12. Зміни до Умов використання
Сервіс moto.free залишає за собою право вносити зміни до цих Умов використання з обґрунтованих причин. Користувачі будуть повідомлені про будь-які зміни електронним способом. Зміни набирають чинності через 14 днів після повідомлення Користувачів.
13. Прикінцеві положення
Ці Умови використання набирають чинності з 1 вересня 2026 року. Питання, не врегульовані цими Умовами, підпорядковуються польському законодавству.
