L'utilisation du Service moto.free, y compris sa navigation, son inscription, sa connexion et l'utilisation des services proposés, est soumise aux règles établies dans ces Conditions d'utilisation. Veuillez les lire attentivement. Ces Conditions d'utilisation sont en vigueur depuis le 1er septembre 2026.
1. Dispositions générales
Ces Conditions d'utilisation définissent les règles par lesquelles le service moto.free fournit l'accès à sa plateforme de petites annonces automobiles, ainsi que les droits et obligations de tous les Utilisateurs. Le Service moto.free est disponible sur le site web moto.free et via l'application mobile.
2. Seller and Contact Details
The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.
3. Définitions
Les termes utilisés dans ces Conditions d'utilisation signifient respectivement : Service — la plateforme moto.free. Utilisateur — toute personne adulte utilisant le Service. Annonceur — un Utilisateur ayant conclu un accord avec le Service pour la publication d'annonces. Annonce — contenu publié par un Annonceur pour la vente d'un Objet d'Annonce. Compte — un enregistrement individuel d'Utilisateur permettant l'utilisation complète des fonctionnalités du Service.
4. Règles d'utilisation du Service
La consultation des annonces est gratuite et disponible sans inscription. L'ajout d'annonces et l'utilisation des fonctionnalités complètes du Service nécessitent un Compte actif. Chaque Utilisateur ne peut avoir qu'un seul Compte lié à une adresse e-mail. Il est interdit de publier du contenu illégal, trompeur ou violant les droits de tiers. moto.free se réserve le droit de supprimer les annonces enfreignant ces Conditions.
5. Inscription et Compte
L'inscription du Compte nécessite de remplir le formulaire d'inscription en fournissant une adresse e-mail et un mot de passe unique, et d'accepter ces Conditions d'utilisation. L'Utilisateur est responsable du maintien de la confidentialité de ses identifiants de Compte.
6. Ajout et modification d'annonces
Une annonce doit se référer sans ambiguïté à la vente d'un seul Objet d'Annonce. Le contenu de l'annonce doit être véridique et juridiquement exact. Un Annonceur peut joindre jusqu'à 9 photos de l'Objet d'Annonce.
7. Paid Services, Prices and Payments
The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.
8. Withdrawal from the Contract and Refunds
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.
9. Responsabilité
Le Service moto.free fournit une plateforme pour publier des annonces et n'est pas responsable du contenu des annonces publiées par les Utilisateurs, de l'exactitude des informations fournies ni de l'état technique ou de la légalité des véhicules proposés.
10. Protection des données personnelles
Le responsable du traitement des données personnelles des Utilisateurs est le propriétaire du Service moto.free. Les données personnelles sont traitées conformément à la législation applicable, notamment le RGPD (UE) 2016/679.
11. Procédure de réclamation
Les Utilisateurs ont le droit de déposer des réclamations concernant le fonctionnement du Service. Les réclamations peuvent être envoyées par voie électronique à l'adresse e-mail indiquée dans le pied de page du Service. Le Service traitera les réclamations dans un délai maximum de 14 jours.
12. Modifications des Conditions d'utilisation
Le Service moto.free se réserve le droit de modifier ces Conditions d'utilisation pour des raisons justifiées. Les Utilisateurs seront informés de tout changement par voie électronique. Les modifications entrent en vigueur 14 jours après notification aux Utilisateurs.
13. Dispositions finales
Ces Conditions d'utilisation entrent en vigueur le 1er septembre 2026. Les questions non régies par ces Conditions seront soumises au droit polonais.
