L'utilizzo del Servizio moto.free, inclusa la sua navigazione, registrazione, accesso e utilizzo dei servizi offerti, è soggetto alle regole stabilite in questi Termini di Utilizzo. Si prega di leggerli attentamente. Questi Termini di Utilizzo sono in vigore dal 1° settembre 2026.
1. Disposizioni generali
Questi Termini di Utilizzo definiscono le regole con cui il servizio moto.free fornisce accesso alla sua piattaforma di annunci di veicoli, nonché i diritti e gli obblighi di tutti gli Utenti. Il Servizio moto.free è disponibile sul sito web moto.free e tramite l'applicazione mobile.
2. Seller and Contact Details
The owner of the moto.free Service, the service provider and the seller of paid services (the "Seller") is SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska, VAT ID (NIP) 7282566198, REGON 100443421, registered in the Polish Central Register and Information on Economic Activity (CEIDG). This address is both the business address and the correspondence address, including for complaints and withdrawal statements. Customer service is provided remotely by email at [email protected] and by phone at +48 790 594 373 on business days between 9:00 - 17:00; no in-person customer service is provided at the Seller's address. Calls are charged at no more than the standard rate of the Customer's telecom operator.
3. Definizioni
I termini utilizzati in questi Termini di Utilizzo significano rispettivamente: Servizio — la piattaforma moto.free. Utente — qualsiasi persona adulta che utilizza il Servizio. Inserzionista — un Utente che ha concluso un accordo con il Servizio per la pubblicazione di annunci. Annuncio — contenuto pubblicato da un Inserzionista per la vendita di un Oggetto dell'Annuncio. Account — una registrazione individuale dell'Utente che consente l'utilizzo completo delle funzionalità del Servizio.
4. Regole di utilizzo del Servizio
La visualizzazione degli annunci è gratuita e disponibile senza registrazione. L'aggiunta di annunci e l'utilizzo completo del Servizio richiedono un Account attivo. Ogni Utente può avere un solo Account associato a un indirizzo e-mail. È vietato pubblicare contenuti illegali, fuorvianti o che violino i diritti di terzi. moto.free si riserva il diritto di eliminare gli annunci che violano questi Termini.
5. Registrazione e Account
La registrazione dell'Account richiede la compilazione del modulo di registrazione con indirizzo e-mail e password univoca, e l'accettazione di questi Termini di Utilizzo. L'Utente è responsabile del mantenimento della riservatezza delle proprie credenziali Account.
6. Aggiunta e modifica degli annunci
Un annuncio deve riferirsi inequivocabilmente alla vendita di un singolo Oggetto dell'Annuncio. Il contenuto dell'annuncio deve essere veritiero e giuridicamente corretto. Un Inserzionista può allegare fino a 9 foto dell'Oggetto dell'Annuncio.
7. Paid Services, Prices and Payments
The Service does not sell goods — the only subject of contracts concluded with the Seller are listing publication services. Publishing a listing under the basic plan is free of charge. Higher-visibility plans are paid; their scope, publication period and current prices are set out in the Price List available in the Service. Prices shown are gross prices, include all taxes and are final — the Customer pays no additional fees, including payment handling fees. The contract for a paid service is concluded when payment is successfully completed, and publication begins once the listing is approved by moderation. Payment is one-off and covers the entire paid publication period. Available payment methods are BLIK, payment cards (Visa, Mastercard), instant online bank transfers (pay-by-link) and the Google Pay and Apple Pay wallets. The payment operator is Przelewy24 — PayPro S.A., ul. Pastelowa 8, 60-198 Poznań, Poland, NIP 7792369887, KRS 0000347935, a national payment institution supervised by the Polish Financial Supervision Authority (KNF). The Seller neither processes nor stores payment card data — it is transmitted directly to the payment operator. At the Customer's request sent to [email protected], the Seller issues and sends an invoice electronically.
8. Withdrawal from the Contract and Refunds
A consumer, as well as a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from a distance contract without giving a reason within 14 days of its conclusion, pursuant to the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, item 827, as amended). Sending the statement before the deadline is sufficient — to [email protected] or in writing to the Seller's address: SRCODE MAREK ANSELM, ul. Ficowskiego 8 m. 28, 01-747 Warszawa, Polska. The statement may be made in any form, including using the model withdrawal form set out in Annex 2 to that Act. If the Customer expressly requested that publication of a paid listing begin before the withdrawal period expires, upon withdrawal they pay for the service provided until withdrawal, in proportion to the publication period used; the right of withdrawal expires once the service has been fully performed, i.e. at the end of the paid publication period (Article 38(1) of the Act). The Seller refunds the payment promptly, no later than 14 days from receiving the statement, using the same payment method the Customer used, unless the Customer expressly agrees to another method; the refund is free of charge for the Customer. If a paid service was not performed or was performed improperly — in particular where a listing was not published or was removed for reasons attributable to the Service — the Customer is entitled to a full refund, which is claimed under the complaint procedure described below.
9. Responsabilità
Il Servizio moto.free fornisce una piattaforma per la pubblicazione di annunci e non è responsabile del contenuto degli annunci pubblicati dagli Utenti, dell'accuratezza delle informazioni fornite né delle condizioni tecniche o della legalità dei veicoli offerti.
10. Protezione dei dati personali
Il responsabile del trattamento dei dati personali degli Utenti è il proprietario del Servizio moto.free. I dati personali vengono trattati in conformità con la legislazione applicabile, in particolare il GDPR (UE) 2016/679.
11. Procedura di reclamo
Gli Utenti hanno il diritto di presentare reclami riguardanti il funzionamento del Servizio. I reclami possono essere inviati elettronicamente all'indirizzo e-mail indicato nel footer del Servizio. Il Servizio tratterà i reclami entro un massimo di 14 giorni.
12. Modifiche ai Termini di Utilizzo
Il Servizio moto.free si riserva il diritto di modificare questi Termini di Utilizzo per ragioni giustificate. Gli Utenti saranno informati di eventuali modifiche per via elettronica. Le modifiche entrano in vigore 14 giorni dopo la notifica agli Utenti.
13. Disposizioni finali
Questi Termini di Utilizzo entrano in vigore il 1° settembre 2026. Le questioni non disciplinate da questi Termini saranno soggette alla legge polacca.
